Terms and Conditions
By having projects completed by Serene Destiny, you are giving me permission to use your company name on serenedestiny.com and/or any marketing materials as a completed project and/or a listed client unless noted otherwise.Pricing
Pricing is determined by complexity of the project, and the time spent on the project. Once a quote is presented, the client may either accept or reject the quote. If the client rejects the quote, the designer has the right to deny the project, or take away time-consuming aspects to lower the price.
Each quote is valid for a period of 30 days, although the start date will change with a delay, if more than 30 days have passed since the creation of this estimate, a new estimate will be drafted to reflect the changing marketplace.
Payment
ALL PROJECTS REQUIRE A 50% SECURITY DEPOSIT. The preferred method is via Pay Pal, but if this is unavailable to you, conditions will be discussed. Before the project begins, the deposit must be paid within 3 days from when the invoice was sent unless noted otherwise. If the deposit is not paid, you will be contacted. If there is no response within 7 days, the project may be terminated.
All payments are final, non transferable and non refundable regardless if project was completed. The deposit is only refundable if the designer cancels the project.
Time Frames
Once the client accepts the designer’s quote, the designer will layout a time frame. The time frames will describe each step, and how long each step will take. The time frames are accurate estimates, but can be changed by actions of the client. The time frames will vary between each project.
The designer has the right to deny rush jobs. If the designer decides to accept a rush job, then a rush fee will be totaled with the invoice. If the job needs to be completed within 24 hours, the rush fee is increased.
When we begin work on your project please make every attempt to remain in communication, a delay in responding to emails asking for approval or changes will result in a delay in finishing the project. A delay of more than 5 days of no communication will result in your project being put on ‘hold’ so I may begin work on other projects, when you return we can then discuss when work will resume on your project (presumably will be next in line after I finish the project I began while you were away, assuming that start date works for your schedule.) A delay of more than 1 month without prior notification will result in your project ending and will not be eligible for any refunds. To resume work after more than a month of no communication we will re-evaluate what remains to be done and send estimate from there.
Hosting/Domain Name
If the client needs hosting and/or a domain name, the designer is not responsible for purchasing those. The client is responsible for covering that cost. The price quoted by the designer DOES NOT include a domain name nor a host. Nonetheless, the designer will recommend you to reliable hosting and affordable domain name websites if needed.
Files/Pictures
If any specific files or pictures need to be on the website, the client is responsible for sending the files or pictures via Email. Please specify where each picture or file goes while sending files or pictures.
Design Services
Once the project is accepted, the designer will create a concept of the website’s design. From there, you must provide feedback and constructive criticism. You may also ask for revisions. You are allowed 10 revisions until a revision fee of $30 each is billed. If the criticism is very offensive, or considered harassment, the designer has the right to terminate the project. No refund will be given.
Programming Services
For Website services, after the client is 100% satisfied with their design, the designer will begin coding the website. If you request revisions during this process, the revisions are not reset. The revisions will add from the number of revisions requested during the design process.
For PSD to xHTML/CSS services, the client must send the PSD via email. It must not be any other file extension, or the designer cannot accept the project.
Copy writing
The client is responsible for providing information to be displayed. The designer is not responsible for writing copy for any project. If there is no copy provided, then the designer cannot continue with project.
End Result
Once the project is completed, the client MUST pay the remaining 50% of the project. Once the payment is completed, every single file will be sent to the client via email. If the remaining payment is not paid within 7 days, you will be contacted by Pay pal
The files to the website is provided as is and Serene Destiny will not be held liable for any damages including in the event that the client attempts to alter or update its content. In no event will Serene Destiny be liable to the client or any third party, including cyber attacks for any damages, lost profits, lost savings or other incidental, consequential or special damages arising out of the operation of or inability to operate the clients web pages/website.
Website Maintenance
The designer is not responsible for maintaining the client’s website. However, the client may hire the designer as the maintainer for a monthly payment. If the client does not wish to hire the designer, but requests updates, each update will have a fee. The fee varies between how complex, and time consuming the update is.
Secondly, the client has the option of learning how to update certain parts of their website for a minimal fee. If a client chooses to use this option, the designer will send a text file of instructions for the client to learn from when the designer finishes the project.
Copyright
Once the project has been completed and all the files are sent; the client has full rights over the website. The designer has the right to put the project on their portfolio and put a link the client’s website footer. The client may request to take out the link though.
